In a filling machine of the rotary type for filling of bottles or similar containers with a fluid filling substance, with a rotor which can be rotated around a vertical machine axis, with a tank provided on the rotor whose tank chamber forms a fluid chamber taken up by the fluid filling substance and a gas chamber lying above it, with several filling elements foreseen on the rotor, which in a filling element housing have respectively a fluid duct with a fluid valve between a fluid connector to the fluid chamber and a discharge opening foreseen on the lower side of the housing (9), as well as with a return gas pipe open at the discharge opening and connected to gas paths designed in the filling element housing, and in each filling element there are one not-controlled gas path with at least one throttle as well as one first control gas pat with at least one first gas path control valve, through which the return gas pipe can be connected to the gas chamber of the tank.
